Our Approach to Your Privacy

This Privacy Policy governs your use of Oak Tree Memories ("Oak Tree" or the "Service"), operated by Oak Tree Memories, Inc. ("we," "us," or "our"). Oak Tree exists to hold your family's most personal memories. We think privacy is a product feature, not a checkbox — so we've tried to write this policy the way we'd want one written for our own family's information.

The short version: we collect what we need to run the Service, we don't sell your data, we don't use your family's private stories to train AI models, and we tell you plainly what we do.

This policy currently applies to residents of the United States. Oak Tree is not currently offered to residents of the European Union, United Kingdom, or other jurisdictions outside the United States. If this changes, we will update this policy accordingly.

1. Information We Collect

Information you provide directly:

  • Account information (name, email address) via our authentication provider, Clerk, Inc.
  • Google (Sign-In) — If you choose to sign in using your Google account, Google acts as your identity provider via Clerk. Google may set its own cookies as part of this process, governed by Google's own privacy policy. Oak Tree does not receive or have access to your Google account credentials, cookies, or activity — only confirmation that you are who you say you are.
  • Family member information you add (names, birth years, relationships, bios)
  • Stories, memories, recipes, digital images, and any other content you or your family members choose to share
  • Payment information, handled directly by Stripe — Oak Tree does not store your full card number
  • Anything you send us directly, such as support requests or feedback

Information collected automatically:

  • Basic technical information needed to operate the Service (such as login timestamps and device/browser information for security purposes)

We do not use tracking cookies for advertising, and Oak Tree does not display ads.

2. How We Use Information

We use your information to:

  • Operate and improve the Service
  • Deliver the Ask Family AI feature, using your family's own stories to generate responses
  • Send you service-related communications (trial reminders, account status, receipts)
  • Send you optional communications you can unsubscribe from at any time
  • Maintain the security and integrity of the Service

3. How Artificial Intelligence Is Used

Oak Tree uses Anthropic's Claude API to power the Ask Family feature. When you ask a question, relevant stories from your family's private library are sent to Claude to generate a response.

  • We do not use your family's stories to train AI models — not Claude's, not our own, not for other customers.
  • Anthropic processes this data under its own data handling terms as our service provider; it is not used to train Anthropic's models when accessed this way.
  • AI-generated responses draw only from what your family has actually shared. We do not use AI to invent facts about your family.

4. Who We Share Information With

We share information only with the service providers who help us operate Oak Tree, under agreements requiring them to protect it:

We do not sell your personal information to anyone, for any purpose.

We may disclose information if required by law, or to protect the safety, rights, or property of Oak Tree, our users, or the public.

5. Data Retention

Your family's stories and information are retained according to the schedule described in our Terms of Service, which addresses trial accounts, active subscriptions, and what happens if an account becomes dormant. In short:

  • Active accounts: retained as long as the account is active
  • Dormant trial accounts: media deleted after 90 days dormant (with advance warning); text stories retained and reactivatable for up to 1 year, after which the account is removed with advance notice and a free opportunity to export your data
  • Dormant accounts that were previously paying: media deleted after 1 year dormant (with advance warning); text stories retained and reactivatable for up to 2 years, after which the account is removed with advance notice and a free opportunity to export your data

You can request deletion of your account and data at any time by contacting us, without waiting for these timelines.

6. Your Rights

Depending on where you live, you may have rights to:

  • Know what personal information we hold about you
  • Access a copy of it
  • Correct inaccurate information
  • Delete your information (subject to what we need to retain for legitimate business or legal reasons)
  • Export your data in a usable format at any time — this is a standing feature of Oak Tree, not something you need to request

To exercise any of these rights, contact us at legal@oaktreememories.com. We will respond within a reasonable time, consistent with applicable state law (such as the California Consumer Privacy Act and similar laws in other states).

We do not sell personal information, so there is no "opt-out of sale" needed — there's nothing to opt out of.

7. Children's Privacy

Oak Tree is not directed at children, and we do not knowingly collect personal information from anyone under 18. If we learn that we've collected information from a minor without appropriate consent, we will delete it. If you believe this has happened, please contact us immediately.

8. Data Security

We use industry-standard measures to protect your information, including encryption in transit and at rest. No system is perfectly secure, and we can't guarantee absolute security — but we treat your family's data and memories the way we'd want our own treated.

9. Changes to This Policy

If we make material changes to this policy, we'll notify you by email or through the Service before the changes take effect.
